1.         Legal information

 

1.1.     This digital recruiting platform «www. https:// https://viterbit.com/» (the "Platform") is managed by CJP IFY 2019 S.L. ("CJP" or "we"), a company legally constituted under Spanish law, having the corporate address at Carrer Professor Barraquer, 36 1E, Esplugues de Llobregat, 08950, Barcelona, the Spanish tax identification number (N.I.F.) 1.2.     CJP provides the companies of the CJP Group with recruiting services, among others. Any exclusion of liability, indemnity or right set out herein shall be also understood applicable to such companies of the CJP Group (please see the Privacy Policy).

 

2.         Acceptance and integrity

 

2.1.     The access and use of our Platform, as well as its information, services and contents are subject to the applicable regulations, the provisions established in this Legal Notice and other policies of the Platform (“Platform Policies”).

 

2.2.     Users of this Platform ("User/s") acknowledge and agree to have read and understood the Platform Policies. By using our Platform, the User expressly acknowledges and agrees to be bound by them to the extent that they are applicable.

 

2.3.     The unlawfulness, invalidity, or unenforceability of any of the provisions of the Platform Policies shall not affect the enforceability of the remaining provisions. Such provisions shall be replaced or integrated with other provisions which, being in accordance with the law, meet the purpose of the substituted provisions. The parties waive any claim for damages that may be claimed because of such circumstance.

 

3.         Modification

 

3.1.     CJP reserves the right to modify the Platform Policies. It is therefore important that the User consults them regularly. Please note that in no event the modifications will be applied retroactively.

 

3.2.     These Platform Policies shall prevail, in the event of any conflict between these Platform Policies and any previous versions, unless otherwise is decided.

           

 

4.         Use of the Platform

 

4.1.     The Platform allows Users to apply for a job opportunity within the CJP Group. The use of the Platform is free. To use the Platform, the User may be required to set up an account. Users shall be solely responsible for keeping their username and password in a safe way. Users should not share their credentials. The user accounts are personal and not transferable.

 

4.2.     The User agrees to use the Platform in accordance with the law, morality, generally accepted best practice, public order and the conditions and policies of the Platform. In particular, though not exhaustively, the User agrees not to use the Platform for illegal purposes, or those contrary to the provisions of the Platform Policies, undermine our rights and/or interests, as well as those of third parties, or to otherwise damage, disable, overload, or impair the Platform or prevent its normal use.

 

4.3.     We reserve the right, at any time and without prior notice, to disable, temporarily or permanently, the User's access to the Platform and its contents if, in our opinion, the User has violated any provision of the Platform Policies and/or regulations applicable to the latter, or there is any reasonable doubt in this regard.

 

4.4.     The services of the Platform do not include the network connection necessary for the Platform to function, and it is up to each User to contract with the operator of their choice. Nor do they include the device necessary for the Platform to function, and it is up to each User to acquire the device of their choice.

 

5.         Exclusions of liability

 

5.1.     In view of the unforeseeable situations that characterise technological environments and the Internet, CJP reserves the right to temporarily suspend the services of the Platform, whether for technical, security or maintenance reasons.

 

5.2.     Suspension of services does not confer any right to compensation or indemnification on the User. However, CJP will endeavour to limit, whenever possible, any suspension or interruption of the services.

 

5.3.     Furthermore, CJP reserves the right to implement and make changes and/or updates to the Platform at any time, with or without prior notice, which may affect the accessibility of the Platform.

 

5.4.     In this regard, the User accepts that CJP shall not be liable, because of such actions, for the elimination or failure to make available certain services or functionalities of the Platform.

 

5.5.     CJP does not represent or guarantee that certain results will be obtained from the use of the services of the Platform. Accordingly, in no event shall CJP, its representatives, directors or employees be liable for any incidental, indirect or direct damages, including, but not limited to, any loss of income, consequential damages, loss of profits, data or business opportunity or software errors, whether foreseeable or not, resulting from or in connection, directly or indirectly, with the use of the Platform.

 

5.6.     Under no circumstances shall CJP be liable for any content, activities, products and/or services that can be accessed via electronic links (including "deep links"), directly or indirectly, related to our Platform. The links included or that may be included on our Platform do not represent any type of relationship between CJP and the individuals or legal entities that own the websites which can be accessed via these links, nor do they imply any suggestion, invitation, or recommendation of any kind about these websites or their contents.

 

5.7.     CJP shall not be liable for any loss or damage that the User may suffer because of improper use of the Platform or failure by the User to comply with the conditions and policies of the Platform or instructions provided by CJP through any communication channel.

 

5.8.     Nor will be held responsible for the use of the Platform by minors or the transfer of their personal data without the permission of their parents or guardians. Being the parents or guardians who shall be held responsible for the safe use of the Internet by the minors in their care. For this purpose, we recommend the installation of a parental control tool for Internet use.

 

5.9.     The creation of frames with the web pages or on the web pages of the Platform, is prohibited.

 

6.         Intellectual and industrial property

 

6.1.     The User acknowledges and agrees that all rights, titles and interests in and associated with the Platform, its contents and software applications, including any modifications, updates and new versions, as well as any distinctive signs (whether registered or not), know-how, trade secrets, intellectual property rights, industrial property rights (whether registered or not), domain names, or any other industrial or intellectual property rights inherent in the Platform, are the exclusive property of CJP or are owned by third parties and used by CJP under licence and with the due authorisation of such third-party owners.

 

6.2.     In this regard, the User acknowledges and accepts that they do not acquire any intellectual or industrial property rights by simply using our Platform and/or any of its functionalities. Therefore, at no time shall such use be considered as an authorisation or licence to use the contents of the Platform, including its texts and policies, for purposes other than those contemplated in the conditions and policies of the Platform.

 

6.3.     Consequently, the total or partial reproduction, modification, transformation, copying, duplication, distribution, public communication, supply to the public, or any other form of exploitation of the Platform, its contents (including its texts and policies), applications, design, and form of presentation of its contents, as well as its source/object code and all those elements that make up its structure and appearance ("look & feel"), is prohibited.

 

6.4.     Likewise, the User acknowledges and accepts that it is prohibited to decompile, reverse engineer, or carry out works derived from the software that supports the operation of and access to the Platform and the services contained therein, unless otherwise permitted by law.

 

6.5.     Failure to comply with any of the provisions herein shall entitle CJP to take appropriate legal action against the infringer to defend its rights, titles, and interests, including the possibility of claiming damages.

 

7.         Applicable law and jurisdiction

 

7.1.     The interpretation and application of the conditions and policies of the Platform shall be governed by Spanish Law unless applicable regulations for the protection of consumers and users set out that the applicable law is that of the domicile of the consumer. This is the case of Spain and most EU countries.

 

7.2.     For the resolution of any discrepancy that may arise in the interpretation and/or execution of the conditions and policies of the Platform, the parties submit to the jurisdiction and competence of the courts of the city of Barcelona (Spain), expressly waiving any other forum to which they may be entitled.

 

7.3.     However, if the applicable regulations for the protection of consumers and users establish the possibility for consumers and/or Users to choose the jurisdiction corresponding to their place of residence, they may proceed in accordance with such regulations. This is the case of Spain and most EU countries.

 

7.4.     Furthermore, in accordance with Article 14 of Regulation (EU) No 524/2013 on online dispute resolution for consumer disputes, we inform Users qualifying as consumers that the European Commission has established an online dispute resolution platform to resolve disputes relating to contractual obligations arising from online sales or service contracts between a consumer resident in the Union and a company established in the Union. 2.         Origin and categories of data

 

2.1.     We will only process the data you provide to us through the digital platform when applying for a job opportunity to the relevant company of the CJP Group to carry out the recruiting process. This includes name, last name, telephone, address, email, job application, social security, job interests, salary, CV information, picture of you, username, password, skill assessment test results, motivation letter, work permit status, citizenship information, and any further data that you may provide us during the recruiting process.

 

2.2.     You guarantee the truthfulness and/or accuracy of this data. Consequently, you will be liable for any false or inaccurate statements you make, as well as for any damages caused to Immfly or third parties as a result.

 

3.         Purpose and legal basis for the processing

 

3.1.     The processing of the data you provide to us is necessary for the performance of recruiting process according to art. 6.1.(b) General Data Protection Regulation (“GDPR”).

 

3.2.     Besides, we will request your consent to retain your CV information during two (2) years in order to inform you about further potential positions that might be of you interest according to art. 6.1.(a) GDPR.

 

3.3.     Finally, we will also process your data to fulfil our legal obligations (tax, accounting, labour, social security, etc.) according to art. 6.1.(c) GDPR.

 

4.         Data storage

 

4.1.     We will retain your data for as long as we reasonably need it for the purposes mentioned.

Where the processing of your data is no longer adequate, relevant, and limited to what is necessary for the purposes for which it is processed, we will store your data securely and only for the purpose of complying with any legal obligations which may arise, as required by law.

 

In addition, if you consent, we will retain your CV information during two (2) years as set out above.

 

5.         Recipients

 

5.1.     As a general rule, we will not disclose your data to third parties. However, in certain cases we may need to disclose your data to:

 

●          Providers: We will provide access to your personal data to those providers who need such access to provide their services to us, such as our platform provider (Viterbit) and CJP IFY 2019 S.L. as the general service provider, including HR, to the companies of the CJP Group. We have in place the relevant legal documents with these third parties to appropriate safeguards to protect your personal information.

 

●          Other: We will share your personal data with third parties, such as labour or social security authorities and to whom it may concern if we are required to do so by law, by an administrative or judicial authority, or in the public interest or for public order, such as, for example, to comply with anti-money laundering and counter-terrorism regulations, tax or social security obligations.

 

5.2.     Finally, in the case of a business restructuring, merger, split, or sale, we may transfer all your personal information to the third party arising from such a transaction.

 

6.         International data transfers

 

6.1.     We do not carry out international transfers of data. However, as is now commonplace, many global providers have their servers outside of the European Economic Area (EEA). Therefore, some of our current providers are located outside, or provide services from, the EEA. In this case, and only where strictly necessary to provide you with the services you request from us, we will make international transfers in connection with the provision of the requested services to such suppliers.

 

6.2.     Besides, note that if you are applying for a position in Immfly Turkey Havacilik Teknolojileri Anonim Şirketi your personal data needs to be transferred to Turkey in order to perform the recruiting process. Likewise in relation to transfer to Andorra if you are applying for a CJP Group company based in Andorra (please see section 1).

 

6.3.     In any event, please note that we will enter into agreements as necessary with all such entities to ensure that they provide adequate safeguards equivalent to those in the EU for such international transfers.

 

7.         Rights

 

7.1.     What are my rights?

 

As provided for in the GDPR and Organic Law 3/2018 on Personal Data Protection and Guarantee of Digital Rights, it is noted that you have the following rights:

           

●          Access: You have the right to access your data to find out what personal data we are processing that concerns you.

 

●          Rectification or erasure: In certain circumstances, you have the right to rectify inaccurate personal data concerning you, which is processed by us, or to ask us to erase it.

 

●          Restriction: In certain circumstances, you have the right to ask us to restrict the processing of your data, in which case it should be noted that we will only retain it for the purpose of exercising or defending claims.

 

●          Portability: In certain circumstances, you have the right to receive the personal data concerning you, which you have provided to us, in a structured, commonly used and machine-readable format and to transmit it to another data controller.

 

●          Objection: In certain circumstances and on grounds pertaining to your particular situation, you have the right to object to the processing of your data, in which case we would stop processing it, other than for compelling legitimate reasons, or for the exercise or defence of possible legal claims. You may object to receiving marketing communications at any time.

 

7.2.     How can I exercise my rights?

 

You may exercise your rights at any time by contacting us as indicated in Section 1, indicating "Privacy" in the subject line. In order to verify your identity, we may ask you to send us certain additional information or documentation, such as, for example, a copy of your ID card or a similar identification.

 

The exercise of these rights is free of charge. However, please note that a fee may be charged when requests are unfounded, excessive, or repetitive.

 

7.3.     Do I have the right to withdraw my consent?

 

Yes, you may withdraw your consent to the processing of your data at any time, where we have asked for your consent to process personal data.

 

7.4.     Do I have the right to lodge a complaint?

 

Yes, you may lodge a complaint with the competent supervisory authority at any time, in accordance with your place of residence. In the case of Spain, this is the Spanish Data Protection Agency (AEPD). You may enquire about the different supervisory authorities by contacting us (please see section 1).

 

In any case, before initiating any complaint, please contact us by e-mail (please see section 1) to try to resolve any discrepancy or dispute amicably.

 

7.5.     When will I get a reply?

 

We will respond to your requests as soon as possible and, in any case, within one (1) month. If this is not the case, we apologise and ask you to contact us again so that we can attend to you and address any possible technical errors that may have prevented us from responding to you within the deadline.

 

8.         Modification

 

8.1.     We reserve the right to modify this Privacy Policy from time to time. In the event of any conflict between this privacy policy and any previous version, unless otherwise decided, this version of Privacy Policy shall prevail.
